Abstract

South Africa has adopted and abides by the major treaties that protect the freedom of association, including, the International Covenant on Civil and Political Rights and the African Charter on Human and Peoples’ Rights, and the right is also enshrined in Clause 18 of the country’s Constitution. Practically, there are three forms of legal entities for nonprofit organisations operating in South Africa, namely voluntary associations, nonprofit trusts, and nonprofit companies. Of these entities, voluntary associations are the most popular because their establishment is quick, inexpensive, and easy.
